These Terms of Use (“Terms”) explain how you can use the Testlet app, website, and related services (together, the “Service”). By accessing or using Testlet, you agree to these Terms. They are here to protect both you and us and to set clear expectations about how the Service works.

If you do not agree with these Terms, please do not use the Service.

Description of the Service

Testlet is an exam preparation application that provides practice quizzes, flashcards, explanations, mock exams, and progress tracking tools.

The Service is designed primarily for individuals preparing for Cosmetology licensing exams. Individuals preparing for related exams (including Barber, Esthetician, Hair Designer, and Nail Technician exams) may also use certain features. However, mock exam simulations are specifically designed for Cosmetology exams only.

Eligibility

The Service is intended for users over the age of 16. By using the Service, you represent that you are at least 16 years old and you are legally able to enter into these Terms. If we become aware that a user is under 16, we may suspend or terminate the account and delete associated data.

Educational Disclaimer (No Guarantee)

Testlet is not an official testing authority, does not administer licensing exams, and is not affiliated with any state board or examination provider.

  • The Service is provided for educational and informational purposes only
  • Use of the Service does not guarantee exam success, licensure, or certification
  • Exam content, format, and requirements may change at any time and vary by state

Accounts

A. Account Creation

To access most features of the Service, you must create a Testlet account. Guest access may be available with limited functionality. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring that the information you provide is accurate and up to date

Accounts are for individual, personal use only. You may not share your account or login credentials with any other person.

If you believe your account has been accessed without authorization, you must notify us immediately at contact@testlet.app. We are not responsible for any loss or damage resulting from unauthorized access caused by your failure to safeguard your account credentials.

B. Account Use & Restrictions

You agree not to:

  • Use another person’s account
  • Share, sell, or transfer your account
  • Access the Service in a way not intended or permitted
  • Circumvent usage limits or subscription restrictions

We may set reasonable limits on usage, features, or storage to ensure reliable operation of the Service. These limits may change over time as the Service evolves.

C. Account Suspension or Termination

We may suspend or terminate your account, with or without notice, if we reasonably believe that:

  • You have violated these Terms
  • You are under the age of 16
  • You have shared your account or misused subscriptions
  • You have attempted to interfere with, hack, or misuse the Service
  • Your use of the Service poses a risk to us, other users, or the integrity of the Service

You may delete your account at any time through the Service or by contacting us. Termination or deletion of an account does not entitle you to any refunds.

D. Guest Access & Limitations

Subscriptions & Purchases

You may explore certain features of the Service without creating an account by using guest mode. Guest access is limited and intended to help you try the Service before creating an account.

When you continue as a guest, you receive a free guest bundle, which includes:

  • One (1) pre-defined practice question (see “Practice Question Sets”)
  • One (1) exam simulation credit/attempt (see “Exam Simulations”)

If you register and verify your email, you will also get a bonus:

  • One (1) practice question credit to unlock a question set of your choice (see “Practice Question Sets”)
  • One (1) additional exam simulation credit/attempt (see “Exam Simulations”)

Monthly Subscription

Testlet offers a recurring monthly subscription that provides unlimited access to all available features while the subscription is active.

Auto-Renewal & Cancellation

  • Subscriptions automatically renew at the end of each billing period unless canceled
  • You may cancel your subscription at any time through your Google Play account settings
  • To avoid being charged for the next billing period, you must cancel at least 1 day before the current subscription period ends
  • If you cancel, you will continue to have access to subscription features until the end of the current billing period
  • After the subscription expires, your account will automatically downgrade to limited access*

We do not have the ability to cancel or modify subscriptions on your behalf.

*Limited Access means that you may continue to use only the practice question sets that you have previously purchased/unlocked, e.g.  through bundles, guest access, or other promotions.

Price Changes

We may change the price of subscriptions from time to time.

  • Any price changes will be communicated to you in advance, in accordance with Google Play’s policies
  • Price changes will take effect on the next renewal date following the notice
  • By continuing to maintain your subscription after the price change takes effect, you agree to the new price, as permitted by law

If you do not agree to a price change, you have the right to cancel your subscription before the new price goes into effect. Please review any price change notifications carefully.

Bundles & One-Time Purchases

Testlet may offer one-time purchases, such as:

  • Question set credits
  • Exam simulation credits
  • Bundles

Question Set Credits

  • You can use question set credits to unlock practice topics
  • When you redeem a question set credit, you receive unlimited access to that topic’s quizzes and flashcards for one (1) year from the redemption date
  • Your access is limited to the specific practice question sets you selected
  • Daily quizzes, incorrect answers, and bookmarks will be based on the practice question sets you have unlocked
  • You may purchase one or multiple question set credits

Exam Simulation Credits

  • The exam simulation credits are used to unlock exam simulator / mock exam
  • Each exam simulation credit is single-use and allows one (1) exam simulation attempt
  • Once an exam simulation is started, the credit is considered used and cannot be restarted, transferred, or reused
  • Incorrect answers from the exam simulation will also be added to incorrect answers practice, even if a particular practice question set wasn’t unlocked yet
  • You may purchase one or multiple exam simulation credits
  • Please note: Each exam simulation presents a mostly unique set of questions based on statistical selection. While the system aims to provide new questions each attempt, some questions may occasionally repeat.

Bundles

  • Bundles provide a specified combination of practice question set credits and exam simulation credits, as displayed on the bundle description
  • The number and type of credits included in a bundle may vary, and Testlet may offer bundles with different combinations or quantities in the future
  • You may purchase one or multiple bundles

Unused credits, attempts or bundles do not extend access beyond their stated duration and have no cash value.

Payments & Refunds

All purchases are processed by Google Play Store. We do not process payments directly and do not store payment information.

Refund Policy

  • Except where required by law, all purchases are non-refundable
  • Refund requests for purchases made through Google Play are subject to Google Play’s refund policies
  • We cannot override or control Google Play’s refund decisions

We do not provide refunds:

  • For partially used subscriptions or bundles
  • If you forget to cancel your subscription
  • If subscription prices change
  • If promotional pricing is offered later
  • If features, content, or structure of the Service change

No Guarantee of Availability

We may update, modify, suspend, or discontinue any part of the Service from time to time. This may include changes to features, content, availability, subscription plans, bundles, pricing structures, or how access and progress are provided.

We will make reasonable efforts to minimize disruption and, where required by law or platform rules, provide advance notice of material changes (such as subscription price changes).

We do not guarantee that any particular feature, content, subscription plan, or pricing option will remain available indefinitely.

Intellectual Property

All content and materials in the Service — including questions, explanations, flashcards, mock exams, software, design, text, graphics, logos, and trademarks — are owned by or licensed to us and are protected by intellectual property laws.

You may not:

  • Copy, reproduce, distribute, resell, or sublicense any content
  • Reverse engineer, scrape, or extract content or data
  • Use the Service for commercial or competitive purposes

Acceptable Use

You agree not to:

  • Use the Service in violation of exam rules or licensing laws
  • Attempt to hack, interfere with, or disrupt the Service
  • Circumvent access controls or subscription limits
  • Use automated tools (bots, scrapers)
  • Share accounts or misuse content
  • Misrepresent your identity or age

Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

By using the Service, you consent to our data practices as described in the Privacy Policy.

Disclaimer of Warranties

The Service and all content provided through Testlet are offered on an “as is” and “as available” basis.

To the fullest extent permitted by law, we make no representations or warranties of any kind, whether express or implied, including but not limited to warranties of:

  • Accuracy or completeness of content
  • Availability or uninterrupted operation
  • Fitness for a particular purpose

Limitation of Liability

To the fullest extent permitted by law, Testlet and its operator(s) shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or relating to your use of (or inability to use) the Service.

This includes, without limitation:

  • exam results or licensing outcomes
  • loss of data or progress
  • loss of profits, revenue, or opportunities
  • service interruptions or content inaccuracies

Maximum Liability

To the fullest extent permitted by law, the total aggregate liability of Testlet and its operator(s) for any and all claims arising out of or relating to the Service shall not exceed one hundred U.S. dollars (USD $100).

This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise, and represents a reasonable allocation of risk between you and us.

Some jurisdictions do not allow limitations on liability in certain circumstances, so this limitation may not apply to you.

Changes to These Terms

We may update this Privacy Policy from time to time.

Non-Material Changes: When we make minor changes (e.g., fixing typos or updating vendor names), we will revise the “Effective Date” at the top of the policy.

Material Changes: For material changes (changes that significantly affect your rights), we will notify you by one or more of the following methods at least 30 days prior to the changes taking effect:

  • Sending an email notification to the primary email address specified in your account.
  • Placing a prominent notice within the Service (e.g., a banner or in-app notification).

Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in the State of Ohio, and you consent to the personal jurisdiction and venue of such courts.
